Terms of Service

These Terms of Service ("Terms") govern your use of the mentAImage mobile application and related services (the "Service") provided by MentaImage Inc. ("MentaImage", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Not medical or clinical care

mentAImage is a wellbeing and stress-awareness platform. It is not a medical device, healthcare provider, mental health provider, therapist, psychologist, physician, social worker, counsellor, emergency service, or crisis service.

The Service does not provide medical advice, diagnosis, treatment, psychotherapy, counselling, or clinical decision-making. Information provided through mentAImage, PulseKey, or Monai is for self-reflection, psychoeducation, stress awareness, and general wellbeing support only. It is not a substitute for professional medical, psychological, legal, or emergency advice.

mentAImage is not intended to diagnose, treat, mitigate, or prevent any disease or medical condition. It does not provide clinical decisions or replace professional judgment.

2. Not crisis support

If you are in immediate danger, thinking about harming yourself or someone else, or experiencing a mental health crisis, do not rely on mentAImage. Contact emergency services immediately: call or text 9-8-8 (Canada suicide crisis support), call 911, go to the nearest emergency department, or reach out to a trusted person.

mentAImage may provide information about support resources, but it is not a crisis service and cannot guarantee real-time monitoring, escalation, or intervention.

3. AI limitations (Monai)

Monai is an AI reflection and coping-skills assistant. You are not speaking with a human therapist, clinician, coach, or crisis responder. Monai may generate supportive reflections and general psychoeducational suggestions, but its responses may be incomplete, inaccurate, or inappropriate for your specific situation. Do not rely on Monai for medical, clinical, emergency, or employment decisions.

4. Third-party AI services

To provide core features, the Service sends certain check-in data to third-party AI services. These are described in detail in our Privacy Policy. In summary:

  • A voice analysis service receives voice audio from PulseKey check-ins to extract vocal wellbeing features. You consent to this during onboarding.
  • An AI reflection and wellbeing analysis service (which powers Monai) receives drawings, text reflections, and wellbeing scores to generate your wellbeing insights. You consent to this during onboarding.

You may withdraw consent to AI processing at any time from Settings. Some features will become unavailable if consent is withdrawn.

5. Employer and organization use

When mentAImage is provided through an employer, institution, or partner organization, the organization receives only aggregated, de-identified group-level insights. Individual check-in content, voice recordings, text reflections, drawings, and individual mental health profiles are not shared with employers. mentAImage is not an employee surveillance tool and is not designed for individual performance evaluation or employment decisions.

6. Eligibility

You must be at least 14 years old to use the Service. Users aged 14 to 17 require verifiable consent from a parent or legal guardian.

7. Your account

  • You are responsible for safeguarding your credentials and for activity under your account.
  • Provide accurate registration information and keep it current.
  • One account per person; do not share accounts.
  • Notify us immediately of any unauthorized access at privacy@mentaimage.com.

8. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract source code, except as permitted by applicable law
  • Use the Service to harm yourself or others, or in violation of any law
  • Probe, scan, or attempt to breach the security of the Service
  • Upload content you do not have the right to share, or that infringes intellectual property
  • Use automated means to access the Service except through documented APIs

9. Your content

You retain ownership of the check-in data you submit (voice recordings, drawings, text responses). You grant MentaImage a limited, revocable license to process this data solely to deliver the Service to you, as described in our Privacy Policy.

10. Subscriptions and payments

If the Service includes paid features, the applicable pricing, billing cycle, and refund terms will be disclosed before purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date through your App Store or Google Play account.

11. Intellectual property

The Service, including its software, design, and trademarks, is owned by MentaImage and protected by Canadian and international intellectual property laws. These Terms do not transfer any ownership rights to you.

12. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may modify or discontinue features with reasonable notice.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be error-free or that any insights generated are accurate, complete, or appropriate for your individual circumstances.

14. Limitation of liability

To the maximum extent permitted by law, MentaImage's total liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) CAD $100. We shall not be liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited under Quebec consumer law.

15. Termination

You may delete your account at any time from Settings or by emailing privacy@mentaimage.com. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

16. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Disputes are subject to the exclusive jurisdiction of the courts of the district of Montreal, Quebec, except where applicable consumer-protection law grants you a different forum.

17. Changes

Material changes will be announced in-app at least 14 days before taking effect.
